Expert witness fees, deposition costs or other third party costs/fees related to the defense of a claim of medical malpractice are subject to a maximum $500.00 deductible per claim, per named certified and/or licensed staff/employee and/or the Practice. The maximum annual aggregate group benefit for the payment of expert witness fees, deposition costs or other third party costs/fees for all claims associated with the defense of a medical malpractice claim will be $5,000.00 or ten percent (10%) of the total annual premium, whichever is greater. Expert witness fees, deposition costs or other third party costs/fees related to Broad-Form defense claims are subject to a maximum $250.00 deductible per claim, per named certified and/or licensed staff/employee and/or the Practice. Expert witness fees, deposition costs, medical record auditing fees or other third party costs/fees payable in connection with Broad-Form defense claims during the policy year shall not exceed an aggregate of $2,500.00. Costs exceeding the maximum shall be the responsibility of the named Practice.
